These Terms and Conditions ("Terms") govern your use of the Marlborough Provincial Museum website (the "Site"), owned and operated by the Marlborough Historical Society (Inc.) ("we", "us", "our"). 2. Intellectual Property and Copyright
Save for explicitly referenced public domain allocations and specific external third-party licensing arrangements detailed within these Terms, all proprietary content on this Site, including but not limited to unique texts, site layout design, compiled historical profiles, curated archival photographs, and specific code structures, is the property of the Marlborough Historical Society or its verified content suppliers and is protected by the Copyright Act 1994 and international copyright laws.
3. Restrictions on Use & AI Prohibition
Except where explicit exceptions are detailed within these Terms, all proprietary content is provided for informational and viewing purposes on this platform only. You are strictly prohibited from copying, reproducing, downloading, printing, distributing, modifying, or publicly displaying any proprietary elements from this Site without our explicit, prior written consent. Third-party licensed digital assets visible on this platform must not be extracted or harvested for external use, as their reproduction rights remain tethered to their respective provider licensing agreements. Furthermore, you must not use any data mining, robots, screen scraping, or similar extraction tools on the Site. This explicitly includes a strict prohibition against harvesting any text, images, or cultural data from this Site to train artificial intelligence models or machine learning algorithms. We will actively enforce our rights against any unauthorised data extraction.
4. Third-Party Attributions
Please note that Canva and Font Awesome have licensed some of the digital icons, vector items, graphics, and interface assets utilised across this Site. All proprietary usage parameters for these individual elements remain protected under their respective licensing models and must not be independently copied or extracted from this platform by third parties.
Additionally, the specific musical recordings made available on the Roll of Honour pages, including the musical compositions and performances of the New Zealand National Anthem ("God Defend New Zealand"), the Royal Anthem ("God Save the King"), and the ceremonial military bugle call ("The Last Post"), are verified public domain resources. These audio tracks were produced and performed by personnel of the United States Armed Forces (United States Navy) during the course of their official duties, meaning they are free from copyright restrictions and enter the public domain globally from the moment of creation. Visitors are reassured that these tracking resources are fully cleared and lawfully utilised for historical commemoration.
5. Cultural Sensitivity, Taonga Māori & Digital Sovereignty
This Site contains images, records, and information regarding taonga (treasures) and tūpuna (ancestors) significant to Māori, particularly regarding the Wairau Bar and local iwi history. We ask that you treat all such material with the utmost respect and dignity. Unauthorised commercial use or appropriation of these cultural assets is strictly prohibited. We recognise and respect Māori digital sovereignty (Te Mana Raraunga). We acknowledge that artificial intelligence generated Māori imagery creates false representations of whakapapa (lineage) and cannot capture true mauri (life force) or wairua (spirit). Therefore, no cultural content, symbolism, or iconography on this Site has been generated from empty canvases by generative artificial intelligence models or algorithmic art engines. To ensure flawless clarity and respect, certain digital historical elements, vector patterns, and photographs may undergo standard digital optimisation, colour grading, sharpening, and restoration using professional software tools or secure graphic library components. All core cultural items and histories remain directly traceable to a verified human, historical, and authentic origin.
6. Accuracy of Historical Information
While we endeavour to ensure that the historical information presented is accurate and reflective of current research, history is an evolving discipline subject to interpretation. We do not warrant that the content is error-free, complete, or current. We expressly disclaim all liability for any reliance placed on historical narratives, dates, or transcriptions provided on this Site.
7. Disclaimers and Limitation of Liability
To the maximum extent permitted by law:
- The Site is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including warranties of merchantability or fitness for a particular purpose.
- We are not liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Site, including but not limited to loss of data, loss of profits, or business interruption.

For living contributors, appropriate consent has been established through direct, informed acknowledgement relevant to the recording context, including verbal clearings for group sessions and community projects. In the case of historical archival audio or media featuring past community members who are now deceased, the integration of these materials is governed by legal copyright stewardship held directly or managed responsibly by the Marlborough Historical Society. Furthermore, any modern or commemorative material featuring the voice or likeness of an individual under the age of 18 is integrated only where standard lawful authorisation has been supplied by a verified parent or key legal guardian. If you wish to review or request the modification of any media asset featuring your personal likeness or that of your legal dependent, please contact us directly.
4. Disclosure and Security
We do not sell, rent, or lease your personal information to third parties. We may disclose your information to trusted third-party service providers (e.g., IT support, payment processors) who assist us in operating our Site and conducting our business, provided they agree to keep this information confidential.
